Site Usage
These Terms and Conditions apply if You wish to become a User of the St Michael's Abbey Web site (a 'User'). St Michael's Abbey, it's partners, employees, servants or agents ('We' or 'Us') is the other party to this contract and can be contacted by email at info@dev.farnboroughabbey.org or through the Contact page

The User ('You') is the person who use the site services.

1. St Michael's Abbey Services

1.1 The St Michael's Abbey Services are those services which are described from time to time on the St Michael's Abbey web site as being provided by Us free of charge and with unrestricted or restricted access. You will be a User if You choose to use one or more of the St Michael's Abbey Services. We reserve our right to refuse Your ability to become a User. We will not charge You for Your use of the general St Michael's Abbey Services (and St Michael's Abbey are not responsible for paying for Your connecting telephone calls). You have certain obligations to Us concerning Your use. Our obligations to You are set out below in Clause 2 and Your obligations to Us are set out in Clause 3.

1.2 Terms and Conditions for St Michael's Abbey Services do not apply to any service We may provide via the St Michael's Abbey web site for which there is a charge. The contract terms that apply to any chargeable service can be viewed on the web pages of such service.

2. Our obligations to You

2.1 We will provide to You access to all non-restricted areas of the site and access to site functionality intended for user access, on the provision that such access is within St Michael's Abbey's reasonable power to supply.

3. Your obligations to Us

3.1 You must use each St Michael's Abbey Service in accordance with the instructions concerning its use as these are set out from time to time on the St Michael's Abbey web site.

3.2 You may use the St Michael's Abbey Services for personal use and business use.

3.3 You must not use the St Michael's Abbey Services in any manner that may constitute a criminal offence or may provide grounds for a civil court case against You, or St Michael's Abbey, or any third party. You must not upload, transmit or download any message or material that:

(a) is defamatory, racist or sexist, threatening or menacing to any person or group of people, or contains any obscene elements (in particular, anything which is or could be interpreted as paedophilia), or which in the reasonable opinion of St Michael's Abbey is likely to cause annoyance or distress to any person; or

(b) infringes the copyright or other intellectual property rights of any other person, company or partnership, anywhere in the world,

3.4 If Your use of the St Michael's Abbey Services causes loss or damage to any other person or company and that person or company claims that their loss or damage is attributable to Your use, You undertake to indemnify us against such a claim. 'Your Use' in this Clause 3.5 includes Use of the St Michael's Abbey Services by anyone who is authorised by You to Use it, or who at the time the claimed loss or damage is caused is a child of whom You are the parent or guardian and for whom You are responsible in law.

4. Limitation of our liability to You

4.1 We will always try to ensure that the St Michael's Abbey Services operate in accordance with our description of them and without any faults. However, We cannot guarantee to You that this will always be the case and because of this We do not accept any liability or responsibility for any faults or errors in the St Michael's Abbey Services, or access to them, or any costs, expenses or loss (including loss of profits, contracts, software or data, or any consequential loss) which may arise from Your access or Use, or inability to access or Use, the St Michael's Abbey Services or any part of them.

4.2 We do not accept any responsibility or liability for enabling You to link to any other Web site, or for the contents of any other Web site, whether one from which You may have been linked or to which You may link from the St Michael's Abbey web site, or for any consequence of Your acting upon the contents of such a Web site.

4.3 We do not accept any liability for any acts or omissions resulting from Your decision or opinion formed on the basis of Your Use of the St Michael's Abbey Services.

4.4 We will always try to offer You the best advice should You have cause to consult Us about the St Michael's Abbey Services. However, We do not accept any liability for any problems that You may experience as a direct or indirect result of such advice. This will not affect the exercise of Your statutory rights.

4.5 We do not accept any responsibility or liability of any kind relating in any way whatsoever to the accuracy of any information contained on the St Michael's Abbey website. Any reliance the User places on any information the St Michael's Abbey website provides is entirely the responsibility of the User, and where any information is relied upon by the User it is the responsiblity of the User to ensure that such information is accurate through any third source before placing any such reliance upon it. We will not be held liable or accountable for any loss or damage (howsoever occuring) suffered as a result of any reliance placed by the User on any information provided by the St Michael's Abbey website, email or partners, employees, servants or agents of St Michael's Abbey. This is an important clause, and the User should not explicitly or impliedly accept this agreement unless this clause is totally acceptable to them.

5. Events beyond Your or Our control

Neither of Us shall be liable to the other for any delay or failure to comply with our obligations under these Terms and Conditions if the delay or failure arises from any cause which is beyond our reasonable control, including (without limitation) any act of God, or of government or regulatory authority, or other internet services provider, war, terrorism, or non-availability or malfunctioning of a telecommunications or broadcast or other network system or service.

6. Termination of these Terms and Conditions

6.1 We reserve the right to terminate the contract between Us set out in these Terms and Conditions, and Your Use of the St Michael's Abbey Services at any time, by notice to You sent via e-mail. Termination will occur at the time You are deemed to receive our notice. If We notify You via the St Michael's Abbey Services the notice shall be deemed to be received by You seven days following transmission. If We notify You by email, Our notice will be deemed received by You five days following mailing.

6.2 You may terminate the contract betWeen Us in the same way as set out in 6.1, except that no termination by You will be effective during the three-month period following its commencement. The contract will continue until the end of that period.

6.3 We may terminate the contract between Us:

(a) if You breach any of these Terms or Conditions;
We will notify You in the same way as set out in 6.1, but if We terminate You for any breach of Clause 3.4 termination will occur at the time We process the information.

7. Intellectual property ownership

All copyrights and other intellectual property rights in the design and contents of St Michael's Abbey are reserved to Thomas Chambers and St Michael's Abbey Press jointly and any licensors that hold a valid license. You may Use it only as St Michael's Abbey expressly permit in these Terms and Conditions and in the specifications on this Web site concerning correct Use of each St Michael's Abbey Service and as St Michael's Abbey expressly permit via email. Use of any copyrights and other intellectual property rights in the design and contents of St Michael's Abbey may not be used for any business purpose, although individual personal use may be permitted. If any teacher wishes to use this material, they may do so providing they notify St Michael's Abbey by email and acknowledge the source of the information. Any unauthorised copying of the design or contents, or other unauthorised Use will infringe the rights of St Michael's Abbey, under international treaty and English law.

8. Amendments to these Terms and Conditions

From time to time St Michael's Abbey may need to change the terms of its contracts with Users and will let Users know on the St Michael's Abbey Home Page when this is to happen and what the changes to these Terms and Conditions will be. If You do not wish to continue as a User under any changed terms, then during a period of seven days following our recording of Your first viewing of the Home Page that contains our notice of the change You can inform Us that You wish to end Your contract with Us. If We receive no such notice from You, You will be deemed to accept the changed terms.

9. Law governing these Terms and Conditions

Because the St Michael's Abbey Services are provided from the United Kingdom, these Terms and Conditions are governed by English law. However, the English courts shall have non-exclusive jurisdiction over these Terms and Conditions, and if appropriate the courts of another country also may have jurisdiction.
